Terms of service

These terms govern the use of MySexyApp at https://mysexyapp.com and of every website created with it. The service is provided by [to be completed], [to be completed] (company ID [to be completed], VAT not registered), referred to below as "we". By creating an account you accept these terms, the content policy and the privacy policy.

1. What the service is

MySexyApp is a website builder. It lets an advertiser create and run a personal or agency website on a subdomain of mysexyapp.com or on their own domain.

  • We provide the software, hosting and the cabinet where the site is managed.
  • We do not take part in any arrangement between an advertiser and their visitors. We do not arrange meetings, take bookings on anyone's behalf, handle payments between them or take a commission.
  • The advertiser alone decides what their site says and offers, and is responsible for it.

2. Who can use it

  • You must be at least 18 years old and have full legal capacity.
  • The service is meant for adults who advertise lawful services in their professional capacity.
  • You must give a working email address and keep your login details secret. You are responsible for everything done through your account.
  • One person may hold several sites. Accounts created to get around a suspension are not allowed.

3. Your content

  • You keep all rights to the texts, photos and videos you upload.
  • You give us a non-exclusive, worldwide, free licence to store, copy, resize, convert and show that content, only so far as needed to run your site and the service. The licence ends when the content is deleted, apart from copies in backups, which are overwritten in the normal backup cycle.
  • You confirm that you own the content or have permission to use it, that every person shown is at least 18 and has agreed to be shown, and that the content meets the content policy and the law of every country where the site is aimed.
  • We may add a small watermark or credit where the chosen plan includes one.

4. Credits, plans and add-ons

  • Paid features are bought with prepaid credits. Credits are bought in packs on the billing page at the price shown there before payment.
  • A plan or add-on runs for 30 days from purchase. With auto-renew on, it is renewed from your credit balance shortly before it ends. Without enough credits it is not renewed.
  • When a plan ends unpaid, the site is no longer shown to visitors. Its content stays in your cabinet and the site comes back as soon as the plan is renewed.
  • When you switch plans, unused days of the old plan are returned to your balance as credits.
  • Credits have no cash value and cannot be transferred. Bought credits are not refunded in money, except where mandatory law requires it or where we end the service without a reason on your side.
  • Payments are processed by the payment providers named on the billing page. Their own terms apply to the payment itself.
  • Prices may change. A change never affects a period already paid for.

5. Custom domains

  • You may connect a domain you own or control. You are responsible for its registration, renewal and DNS settings.
  • You can also buy a domain through us. You are its registrant and owner. The registry rules of its ending apply, and your details must be true. We renew it from your credits while auto-renew is on and your balance allows it, and we send reminders before it expires. You can get its transfer code and move it to another provider at any time. A domain that is not renewed expires; we are not liable for losing it.
  • We issue and renew a TLS certificate for a connected domain automatically. We are not liable if a domain stops working because of its registrar or DNS.

6. Self-hosted licence

Where a self-hosted copy of the software is sold, it is licensed, not sold. Unless the licence document says otherwise:

  • one licence covers one installation on one main domain;
  • updates are provided for the period stated in the licence;
  • you may not resell, sublicense or publish the software or remove its licence check;
  • you run the installation yourself and are the sole controller of everything on it. These terms apply to it only so far as they concern the licence.

7. What is not allowed

You may not use the service to:

  • publish anything forbidden by the content policy;
  • offer or advertise anything illegal, including services involving minors, coercion or trafficking;
  • send spam, phish, spread malware or attack the service or other sites;
  • scrape, overload or get around the technical limits of the service;
  • pretend to be another person or business.

8. Reports, moderation and suspension

  • Anyone can report a site through the Report link in the footer of every site. We review each report without undue delay and act on content we find illegal or against these terms.
  • We do not check content before it is published and are not under a general duty to monitor it.
  • We may remove content, hide a site or suspend an account if it breaks the law, these terms or the content policy, or if we are ordered to by a competent authority. Where the law allows, we tell you the reason and how to object. You can reply to the notice by email at [to be completed], and we review every objection.
  • Serious or repeated breaches can lead to the account being closed. Credits already used are not refunded in that case.

9. Availability and liability

  • We work to keep the service available but do not promise it will run without interruption or errors. Maintenance may cause short pauses.
  • Back up your own content. We keep backups for the safety of the service, not as a storage service for you.
  • We are liable for damage caused intentionally or by gross negligence, and where mandatory law makes us liable. In all other cases our total liability is limited to the amount you paid us in the 12 months before the event. We are not liable for lost profit or for indirect damage.
  • You will compensate us for claims of third parties caused by your content or by your breach of these terms.

10. Ending the service

  • You can stop using the service at any time and ask us to delete your account at [to be completed].
  • We may end the service for an account with 30 days' notice by email, or at once for a serious breach.
  • Personal data is then handled as described in the privacy policy.

11. Changes to these terms

We may change these terms. We announce material changes by email or in the cabinet at least 14 days before they take effect. If you do not agree, you can close your account before that date.

12. Law and disputes

These terms are governed by the law of [to be completed], without limiting mandatory protection given to you by the law of the country where you live. Courts of [to be completed] have jurisdiction, unless mandatory law provides otherwise.
